Biography

Brian Herrmann is a trial lawyer who focuses his practice on intellectual property litigation and commercial litigation. He has represented clients in litigation involving patents, trademarks, copyrights, trade secrets, commercial contracts, and business torts. He has also represented clients before the United States Patent and Trademark Office, including in matters before the Patent Trial and Appeal Board. Additionally, he has represented clients in the areas of intellectual property licensing, commercial arbitration, and international arbitration.

Membership and Bar Admissions

Brian is admitted to practice law in the State of Texas, as well as before the United States District Court for the Eastern and Northern Districts of Texas.  Additionally, he is a registered patent attorney with the United States Patent and Trademark Office.  He is a member of the Dallas Bar Association and the Dallas Association of Young Lawyers

Education

Brian graduated from Duke University with a Bachelor of Science in Engineering in 2008, where he majored in Civil and Environmental Engineering and also obtained a Certificate in Architectural Engineering. He obtained his Juris Doctor degree from Duke University School of Law in 2012.

  • Lone Star Document Mgmt., LLC v. Catalyst Repository Sys., No. 6:12-cv-164 (E.D. Tex. 2013): Represented Plaintiff in patent infringement action involving E-Discovery software. The case settled favorably for the client.
  • SynQor, Inc. v. Artesyn Techs., Inc., No. 2:11-cv-444 (E.D. Tex. 2013): Represented Defendant in patent infringement damages trial.
  • Direct Logistics, Inc. v. Choice Direct Logistics, Inc., No. 3:13-cv-00806 (N.D. Tex. 2013): Represented Plaintiff in trademark infringement action. After successfully moving for dismissal of Defendant’s mirror image declaratory judgment action in the United States District Court for the Northern District of Illinois, the case settled favorably for the client.
  • Celanese International Corporation and Celanese LTD. v. Linde Gas North America LLC: Represented Claimants in commercial supply contract arbitration before the International Chamber of Commerce.
  • CNA Holdings LLC v. Air Products LLC: Represented Claimant in commercial supply contract arbitration before the American Arbitration Association.
  • Rotatable Techs. LLC v. Lennox Indus. LLC, No. 2:13-cv-110 (E.D. Tex. 2013): Represented Defendant in a patent infringement action. After successfully obtaining a transfer of venue for the client, the case settled favorably.
  • CYVA Research Holdings, LLC v. BOK Fin. Corp., No. 2:13-cv-407 (E.D. Tex. 2013): Represented Defendant in patent infringement action. The case settled favorably for the client.
  • Fusion Paperboard Connecticut, LLC v. Celanese Corp., No. 3:13-cv-01026 (D. Conn. 2013): Represented Defendant in breach of contract, breach of warranty, negligent misrepresentation, unjust enrichment and Connecticut Unfair Trade Practices Act action relating to a commercial contract. The case settled favorably for the client.
  • Konnectcorp Int’l, Inc. v. Suntharalingam, No. 3:13-cv-03656 (N.D. Tex. 2013): Represented Defendants in copyright infringement action and obtained dismissal of Plaintiff’s case against clients.
  • Trover Group, Inc. v. Tyco Int’l, LTD, No. 2-13-cv-00052 (E.D. Tex. 2013): Represented Plaintiff in patent infringement action. The case settled favorably for the client.
  • Matson, Inc. v. Cowboy Containments, Inc. et al., No. 3:13-CV-3957-K (N.D. Tex. 2013): Represented one of Co-Defendants in patent infringement action. The case settled favorably for the client.
  • Trover Group, Inc. v. Kaltec Electronics Inc. et al., No. 2:14-cv-1172 (E.D. Tex. 2014): Represented Plaintiff in patent infringement action against multiple Defendants. The cases settled favorably for the client.
  • Olivistar, LLC v. Lennox Indus. LLC, No. 2:14-cv-531 (E.D. Tex. 2014): Represented Defendant in patent infringement action. The case settled favorably for the client.
  • Samsung Techwin America v. Trover Group, Inc., Nos. IPR2015-01296 & IPR2015-01298 (P.T.A.B. 2015): Represented patent owner as lead counsel in Inter Partes Review of patents.
