Copyright Litigation

Given our experience, one could argue that McDole & Williams attorneys have more experience litigating and trying copyright cases than any other firm in Texas. But instead of focusing on the past, we are busy preparing for our next preliminary injunction hearing where we are seeking to prevent further copyright infringement and the impoundment of infringing articles. We are busy registering copyrights for clients, actively advising clients on copyright licensing issues and preparing DMCA take-down letters that will require web hosting companies to remove websites that are actively infringing the copyrights of our clients.

Our copyright attorneys regularly advise clients on a wide variety of issues concerning copyright ownership and rights including:

  • Copyright litigation
  • Copyright and antitrust misuse
  • Licensing agreements
  • Assignments and recordation services
  • Software agreements
  • Joint creation arrangements
  • Digital rights management
  • DMCA issues
  • Internet and cyberspace related issues
  • Public performance rights and display rights
  • Right of integrity
  • Right of attribution
  • Work-for-hire agreements
  • Fair use doctrine
  • Derivative works

The Digital Millennium Copyright Act (DMCA) was signed into law for the purpose of protecting the technologies that are used to protect the underlying copyrighted works. The DMCA also works to protect of service providers from copyright liability due to the infringement of their users.

Ask one of our attorneys about the copyright cases they are working on today.  Or even better, ask them to tell you about some of the cases they have been working over the last 25 years.
